Case Study:

Indianapolis, Ind. – The 5.6 million dollar settlement was approved by the court on Wednesday.  This tragic case involves a helicopter crash that took place in 2008 in Greensburg, Ind. killing a flight nurse and single mother of two.

Roy Tabor of Tabor Law Firm in Indianapolis worked as local counsel with Gary Robb of Robb & Robb, LLC in Missouri to reach this agreement for the Plaintiff.

On August 31, 2008, Sandra Pearson, a 38-year-old Registered Nurse and mother of two, was working as a member of an Air Evac helicopter rescue team based out of Rushville, Ind. While returning to base from a charity function, the helicopter operated by the Air Evac team suffered a catastrophic failure of the main rotor blade.   The blade came apart in mid-air and Sandra Pearson was killed in the resulting crash.  Sandra was survived by her two children, ages seven and nine.

Tabor Law Firm worked with Gary Robb to represent Sandra’s children in a wrongful death suit against the manufacturer of the helicopter.  A National Transportation Safety Board (NTSB) investigation and research by expert air crash investigators hired by Tabor Law Firm revealed the helicopter’s rotor blade fractured due to defects created during the manufacturing of the blade.

“This is a unique settlement for this type of case as Pearson was a single mother with no spouse,” explained Roy Tabor. “Usually in cases involving the death of a parent, the value of the case is determined based on the age of the children and the age of the spouse and reflect the income loss for both the children and the spouse.” Since Pearson had no surviving spouse, the settlement was based on the children’s loss only.

Friends and family of Pearson testified that, “when Sandi walked into a room, it immediately came alive.”  Throughout the length of the case, friends described her as, “the kindest soul that anyone would ever know and she would do anything for anybody.”

The multi-million dollar settlement will provide for Sandra’s two young children.

“Sandra’s children have lost a dedicated and loving parent and this crash will forever impact their lives,” explained Tabor.  “This settlement will help protect the financial future of these two young children.”
