Lawsuit Filed Against Carmel Clay School Corporation and Carmel Bus Driver in Wrongful Death Case

Carmel, Ind. – Carmel parents have filed a lawsuit in the wrongful death of Ziang Ke, a Carmel High School student who was killed while attempting to board a Carmel High School bus.

Early January 2009, a school bus owned by Carmel Clay School Corporation and operated by Anthony D. Fiore, struck Ke as he was proceeding toward the bus near the intersection of Teague Place and Salamone Way in Carmel. After Fiore struck Ke, he then left the scene of the incident without stopping to investigate.

The parents of Ke, represented by Tabor Law Firm, an Indianapolis-based personal injury and wrongful death law firm, have filed a wrongful death claim against the Carmel Clay School Corporation, the bus operator and the Board of School Trustees.

Including seven causes of action, the complaint alleges negligent acts and omissions by the Defendant Fiore in the operation of the school bus, in the implementation and management of the bus boarding process and in failing to investigate and render or summon aid.

Against the Defendants Carmel Clay School Corp. and the Board of Trustees, the complaint alleges a failure to establish a safe and suitable bus transportation program, failure to train and supervise bus drivers, and failure to equip its buses with safety devices to sense the presence of children in proximity of the bus.
